EXECUTIVE SUMMARY Applicant Geysers Power Company, LLC proposes its continued existing use of the Unit 19 geothermal steamfield, consistent with its current and historical permitted uses, under Use Permit UP 93-16 on APN 013-004-15 (formerly four APNs) for 30 more years from the date of approval. Project facilities currently include steamfield access roads; steam, recycled water, and condensate pipelines; and related geothermal wells and facilities. Existing sump facilities will continue to be utilized for disposal of non-hazardous drill cuttings and are permitted by various local, state, and federal agencies, as appropriate. No changes and/or expansion of the authorized uses for the production of geothermal resources from lease holdings on approximately 710 acres near the Lake-Sonoma County line is proposed for this extension. This Use Permit Extension request is associated with the Calistoga Steamfield Unit 19, the associated power plant is licensed by the California Energy Commission. II. RECOMMENDATION Staff recommends that the Planning Commission approve the project with the following findings: A. Adopt Categorical Exemption, Class 1 (CE 22-41) for Use Permit Extension UPX 22-03 with the following findings: 1. This time extension is for an existing use permit to allow continued operation of an existing geothermal steamfield known as Unit 19. There will be no changes and/or expansion of the authorized use and the applicant shall adhere to the conditions of approval. 2. This project is consistent with CEQA Categorical Exemption, Class 1, which specifies the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. 3. This project remains consistent with the Lake County General Plan, Middletown Area Plan and the Lake County Zoning Ordinance. 4. There has been no change in the project which would create new significant environmental impacts. 5. This project is consistent with land uses in the vicinity. 6. This project will not result in any significant adverse environmental impacts. B. Approve the request for a "Life of the Project" Extension of Time UPX 22-03 for Use Permit UP 81-37. 1. This project will not be detrimental to the health, safety, morals, comfort and general welfare of the persons residing or working in the area of the proposed use, or be detrimental to property and improvements in the neighborhood or the general welfare of the County. 2. The site is adequate in size, shape, location, and physical characteristics to accommodate the type of use and level of development proposed. 3. The streets, highways and pedestrian facilities are reasonably adequate to safely accommodate the proposed use. 4. There are adequate services to serve the project. 5. This project is consistent with the Lake County General Plan, Middletown Area Plan and the Lake County Zoning Ordinance. 6. No violation of Chapters 5, 17, 21, 23 or 26 of the Lake County Code currently exists on the properties. III. SAMPLE MOTIONS Categorical Exemption I move that the Planning Commission find that the Use Permit Extension UPX 22-03 applied by Geysers Power Company, LLC on property located at 9010 Socrates Mine Road, in Middletown, CA, on Sections 16, 21, & 22, T11N, R8W, further described as 013-004-15 is exempt from CEQA because it falls within Categorical Exemption Class 1, based on the findings set forth in the Staff Report dated November 17, 2022. The site is adequate in size, shape, locations, and physical characteristics to accommodate the type of use and level of development proposed. 3. The streets, highways, and pedestrian facilities are reasonably adequate to safely accommodate the proposed use. 4. There are adequate services to serve the project. 5. This project is consistent with the Lake County General Plan, Middletown Area Plan, and Lake County Zoning Ordinance. 6. No violation of Chapter 5, 17, 21, 23, or 26 of the Lake County Code currently exists on this property, with a condition of approval implemented. 7. The proposed use complies with all development standards described in Chapter 21, Article 27, Section 1.i. 8. The applicant is qualified to apply for the permit described in Chapter 21, Article 27, Section 1.ii.(g)(h). 9. The application complies with the qualifications for a permit described in Chapter 21, Article 27, Section 1.ii.(i). Resolution 2022-121 Draft Ordinance At the September 27, 2022, Board of Supervisors meeting, the Board adopted Resolution 2022-121, Resolution of Intention of the Lake County Board of Supervisors to Initiate an Amendment to the Zoning Ordinance Relating to Appeals. Supervisor Sabatier presented the item, noting delays in past appeal hearings due to submission of documents up to and on the day of the hearing. When an Appellant or Appellant's Representative submits documentation on the day of a hearing, and the deciding body could not reasonably review the submission during a short break, they would continue the hearing to a future meeting to allow for review. Requiring documents to be submitted within a reasonable time prior to the meeting would allow the deciding body sufficient time for review prior to the public hearing, avoiding delays through the continuation of the hearing to a future meeting date. During the Board discussion, when concerns were expressed about the fairness of establishing a 96-hour limit when meeting agendas are posted no less than 72 hours prior to the meeting, it was noted that historically evidentiary documents are submitted by the Appellant, who receives no less than a 10-day notice of the public hearing. He stated that this ordinance would not impede the public's ability to attend hearings and provide public input because they would be able to access the appeal documents available at the posting of the agenda, and give public input during the public hearing. Resolution 2022-121 is included as Attachment 1 and the Draft Ordinance is included as Attachment 2. Any party wishing to provide documentary evidence and/or written argument shall submit such documentation to the Clerk of the Planning Commission no later than 96 hours prior to the date and time of the Public Hearing. Documentary evidence and/or written argument submitted after that time shall not be considered by the Planning Commission." The following text is recommended for addition as Section 58.36: "Submission of Documentary Evidence and/or Written Argument. Any party wishing to provide documentary evidence and/or written argument shall submit such documentation to the Clerk of the Board of Supervisors no later than 96 hours prior to the date and time of the Public Hearing. Documentary evidence and/or written argument submitted after that time shall not be considered by the Board of Supervisors." The following text is recommended for addition to Section 68.4(d): "10. EXECUTIVE SUMMARY RS Greenery, LLC is seeking a Major Use Permit from the County of Lake, for a proposed commercial cannabis cultivation operation at 6243 Eickhoff Road, Upper Lake (APNs 003-046-02 and 003-046-78). All commercial cannabis cultivation activities would occur on APN 003-046-02 (See Attachment 2 - Site Plans). APN 003-046-78 will be utilized for clustering/combining the acreage. The proposed commercial cannabis cultivation operation would be composed of two (2) A-Type 3 "Medium Outdoor" cultivation areas and one (1) Type 13 Self-Distribution license, two 160 sf metal shipping/ storage containers (proposed Harvest Storage Areas), and two 120 sf wooden sheds (proposed Pesticide & Agricultural Chemicals Storage Area and Security Center), totaling 85,408 sf with 84,848 sf of canopy area. All water for the proposed cultivation operation would come from an existing on-site groundwater well and four plastic 5,000-gallon water storage tanks. The site is accessed via a shared private gravel and native soil surfaced access road off Eickhoff Road. The Project would use approximately 4.1 acre-feet of water per year. II. II. RECOMMENDATION Staff recommends the Planning Commission take the following actions. A. Adopt Mitigated Negative Declaration (IS 21-05) for Major Use Permit (UP 21-05) with the following findings: 1. Executive Summary

The Bylaws for the Planning Commission were last updated in 2000 and are in need of review and an update. Included here are draft amendments to the Bylaws designed to add clarity, more closely reflect the current processes of staff and the Commission, and add an option of alternates to ensure continuity of the Commission in the event of Commissioner absence or ineligibility. Some text has been moved, making a red-lined version of the current Bylaws unwieldy, so, attached to this memo are the draft amended Bylaws (Attachment 2), as well as the existing Bylaws (Attachment 3). A few areas to highlight for the Commission's attention include the following: * Reference to Rosenberg's Rules of Order - this is a set of parliamentary rules more appropriate to smaller groups; * Addition of Alternate Commissioners - With Alternates for each District, the Commission would be able to proceed with a five member voting body in the event that a Commissioner is absent or is ineligible to vote. Included in the draft amended bylaws is the option for five Board appointed alternates, one per district; * Quorum and taking action with less than the full body - this section is added for clarity on what constitutes a quorum and what action may be taken with less than a quorum present; * Reconsideration - this regulates the option for the Commission to revisit an item on which they have already taken action. The addition of Alternate Commissioners would require an ordinance to amend the Lake County Municipal Code, Chapter 2, Article 8: Planning Commissioners. Amendment to the Lake County Code requires Board action, so Staff requests the Planning Commission's recommendation to the Board of Supervisors on the various amendments. Once the Board has provided direction to Staff and the Code amendments are accomplished; the bylaws will return to the Planning Commission for adoption.

Recommended Action

That the Planning Commission make a recommendation to the Board of Supervisors that the Lake County Municipal Code, Chapter 2, Article 8 be amended to allow for the adoption of Planning Commission Alternates.
