6a.9:05 a.m. - PUBLIC HEARING - Consideration of a variance to setbacks (VR 23-01), and Initial Study (IS 23-04), for the Hidden Valley Fire Station, a new 8,000-sf fire station; Applicant: Skiles and Associates; Located: 19237 Hartmann Road, Hidden Valley Lake (APN: 141-381-02)

Executive Summary
Consideration of proposed �8,000 sf new fire station for the Hidden Valley Lake Fire Station. This project is for a variance to setbacks due to the size, shape, and location of the Fire Station building. The lot is 100 feet wide by 280 feet long and is 50% developed with the existing 2,800-sf Hidden Valley Lake Fire Station. There is a seasonal water course located immediately behind the property that requires a 30' setback. The setbacks required for the new building cannot be met without eliminating the functionality of the building as a fire station; therefore, a variance to the setbacks is being sought.
Recommended Action
Staff recommends the Planning Commission take the following actions:
A. Adopt Mitigated Negative Declaration (IS 23-04), for Variance (VR 23-01), with the following findings:
1. Potential environmental impacts related to Air Quality can be reduced to 'less than significant' with the inclusion of mitigation measures AQ-1 through AQ-4.
2. Potential environmental impacts related to Cultural / Tribal Resources can be reduced to 'less than significant' levels with the inclusion of mitigation measures CUL-1 and CUL-2.
3. Potential environmental impacts related to Noise can be reduced to 'less than significant' levels through the inclusion of mitigation measures NOI-1 and NOI-2.
4. The project can be brought to 'less than significant' impact levels through specific mitigation measures.
B. Approve Variance (VR 23-01), with the following findings:
1. That because of special circumstances applicable to subject property, the strict application of the development standards of this Chapter are found to deprive subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification.
2. That any variance granted is subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated.
3. That the granting of the variance is in accordance with the intent of this Chapter, is consistent with the General Plan and will not be detrimental to public safety, health, and welfare, or injurious to other properties in the vicinity.
4. That granting the variance will not be detrimental to the County or the surrounding area.

Executive Summary
The Lake County Administrative Office (Applicant) has secured federal funding for the acquisition and remodeling/refurbishment of the facilities currently owned by Kelseyville Senior, Inc. and utilized for the Kelseyville Senior Center (approved via Major Use Permit 02-14 in 2003), located at 5245 Third St., Kelseyville, CA 95451.
Following property purchase, the County will immediately lease back the parcel to Kelseyville Senior, Inc. for continued use under the existing use permit (UP 02-14). Consideration of the lease and purchase agreements were scheduled for the November 28, 2023 Board of Supervisor's (BOS) meeting, but the item(s) were continued to the December 19, 2023 BOS meeting agenda, pending approval of a General Plan Conformity determination, pursuant to Government Code Title 7, Division 1, Chapter 3, Article 7, Section 65402, which states that before the County can purchase property a determination of conformity with the Lake County General Plan must be made by the Planning Commission.
Once under County ownership, the County's Public Services Department will also issue a Request for Proposals (RFP) for facility improvements to promote Americans with Disabilities Act compliance and support the functional needs and access of the population served. The details and scope of the improvements will not be known until bids are received in response to the RFP and a contract for improvements are awarded.
As such, at this time, the only action being considered by the Planning Commission is the General Plan Conformity determination for acquisition of the property.
Recommended Action
Staff recommends the Planning Commission, after reviewing the agenda report and receiving evidence at the public meeting, find that the location, purpose, and extent of the proposed property acquisition, located at 5245 Third St., Kelseyville, CA 95451, is in conformance with the County of Lake General Plan pursuant to California Government Code Section 65402.
6d.9:20 a.m. - PUBLIC HEARING - Consideration of Recommendations from the Cannabis Ordinance Task Force regarding Zoning Districts and Permit Types for Various Cannabis-Related Businesses

Executive Summary
Since its formation by the Board of Supervisors on July 12, 2022, the Cannabis Ordinance Task Force (COTF) has met regularly, working on a number of draft ordinances which were Board priorities, and more recently, on recommendations for revising the current cannabis policy. Attached please find a list and table of recommended cannabis-related business types, the zoning districts in which those businesses could operate, and the level of permitting required. These recommendations were reviewed by the Agriculture Advisory Committee on October 10, 2023, and November 20, 2023, without any recommended changes.
The COTF recommendations include agriculture, commercial, and industrial zoning districts. There are new business types and uses, existing uses in additional locations, and changes in the level of permit required. The Community Development Department offers three type of land use planning permits:
* Zoning Permit- is a ministerial permit; the application is approved if it is compliant with the regulations. Ministerial permits do not go through environmental review.
* Minor and Major Use Permits- are discretionary. Both permits include agency review, environmental review, and conditional consideration of either the Zoning Administrator (minor use permit), or Planning Commission (major use permit). For brevity, titles of zoning districts are listed below, and omitted elsewhere in this memorandum.

A summary of recommendations from the COTF are provided in Table 1. The recommendations from COTF are conceptual in nature. It has come to the Planning Commission for review and recommendations. These recommendations will be added to the presentation to the Board for its consideration and direction, prior to COTF work on development standards so that the task force will concentrate only on cannabis related business types the Board is willing to consider in a future ordinance. Staff requests Planning Commission recommendations on the COTF recommendations regarding the cannabis related business types, zoning districts, and permit levels.
