DESIGNATING THE MONTH OF OCTOBER 2024 AS PREGNANCY AND EARLY INFANT LOSS AWARENESS MONTH IN LAKE COUNTY WHEREAS, Pregnancy and Early Infant Loss is more common than we realize. It is estimated in the United States that 1 in 4 pregnancies end in miscarriage, 1 in 175 pregnancies end in stillbirth, and 5 infants per 1000 die before their first birthday; and WHEREAS, many Lake County parents and families have suffered a miscarriage, a stillbirth or the death of an infant during delivery or shortly after birth, and such a terrible loss is often not recognized; and WHEREAS, Lake County wishes to acknowledge the profound grief experienced by families who suffer the death of a small child, infant, or pre-term baby; and WHEREAS, even the shortest lives are still valuable, and the grief of those who mourn the loss of these lives is significant; and WHEREAS, the 15th day of October is recognized in the United States and around the world, as a day of remembrance and awareness of pregnancy and early infant loss, when Mother-Wise will host a free, community event at 6pm at THAT Ranch in Lakeport for those who have experienced this profound loss; and WHEREAS, increased awareness of the causes and impacts surrounding pregnancy and infant loss may lead to greater understanding, support, and resources in communities across Lake County; and WHEREAS, recognizing Pregnancy and Early Infant Loss Awareness Month and Remembrance Day would enable the people of Lake County to consider how, as individuals and communities, they can meet the needs of bereaved mothers, fathers, and family members, and work to prevent the causes of these deaths. Adopt Proclamation Recognizing Hispanic Heritage Month in Lake County

As the County Mental Health Plan, LCBHS is responsible for the placement and payment of acute inpatient psychiatric hospital services. LCBHS works with a variety of hospital across the northern region of the state to find placement for our beneficiaries who require this level of care. These services are largely reimbursable from Medi-Cal and MediCare, depending on the beneficiaries' aid codes. The County match to be eligible for a claim and reimbursement of Federal Financial Participation (FFP) comes from realignment dollars.

Approve Agreement between County of Lake and BHC Sierra Vista Hospital, INC. for Acute Inpatient Psychiatric Hospital Services and Professional Services Associated with Acute Inpatient Psychiatric Hospitalizations in the amount of $50,000 for Fiscal Year 2024-25 and Authorize the Board Chair to Sign.

The Lake County Department of Social Services (LCDSS) currently has two separate contracts in place with the California Department of Social Services (CDSS). One for the provision of Agency Adoption Services, and one for Resource Family Approval (RFA) Family Evaluations. CDSS is requesting that we merge these two contracts. The RFA program is a unified, family friendly, and child-centered process that helps to provide more placement opportunities for foster children and reduces the likelihood they are placed in a group home. The family evaluations include interviews of applicants to assess their personal history, family dynamic, and a need for support or resources, and a risk assessment. CDSS is the only entity other than the County, that can perform Adoption Services which includes case management, assessments of children and prospective adoptive parents, completion of reporting requirements, medical and social background checks, the provision of relinquishment services for birth/legal guardians, and other related adoption services as needed. CDSS's role is essential for the continued functionality and success of these programs; contracting these services to CDSS has served Lake County well. This agreement combines both existing contracts into a single contract. CDSS requires LCDSS to provide a signed and adopted resolution in addition to the signed Contract, authorizing the execution of the Contract. The direction of our original memo did not accurately detail this action. We are returning to your Board asking for approval of the Resolution at this time. Typically, we would request approval for the Social Services Director to sign the Standard Agreement. However, this is an Amendment to a Contract (#240585) that was originally signed by the Board. CDSS requires we obtain the same signatures as the original amendment.

Proposed Draft GPAP Resolution PROJECT DESCRIPTION The proposed project includes a Rezone to change the zoning designation from "O-SC" Open Space - Scenic Combining to "R1-SC" Single-Family Residential - Scenic Combining, and a General Plan Amendment to change the general plan designation from "PF" Public Facilities to "R1-SC" Single-Family Residential - Scenic Combining. The site is located at 9460 E. State Highway 20, Glenhaven. The Rezone and General Plan Amendment are proposed to allow conversion of the existing structure (previously utilized as a fire station) to a single-family residence. BACKGROUND The property was purchased on February 19, 2020, by the previous owner from the Clearlake Oaks Fire Protection District who stated in a comment letter that a rezone was included in the Sales Agreement. However, the previous owner sold the property to the applicant without completing a rezone and general plan amendment. The applicant started converting the structure to a single-family home without building permits and a Stop Work Notice was issued by the Lake County Community Development Department, Building Division on May 4, 2023. A detailed project description and analysis of the project can be found in the August 22, 2024, Planning Commission Staff Report included in Attachment B. Additional attachments include the following: Attachment A. Vicinity Map, Attachment C. Draft Planning Commission Minutes, Attachment D. Exhibit "A" Zoning and General Plan Amendment Map, Attachment E. Planning Commission Resolution, Attachment F. Proposed Draft Rezone Ordinance, and Attachment G. Proposed Draft GPAP Resolution On August 22, 2024, the Planning Commission took the following actions related to the proposed project: 1. The Planning Commission adopt Negative Declaration (IS 23-15) for Melissa Lim for a property located at 9460 E. Highway 20, Glenhaven (APN 035-041-19) based on the findings in the staff report dated August 22, 2024. 2. The Planning Commission recommend that the Board of Supervisors approve the Rezone (RZ 23-02) applied for by Melissa Lim to change the zoning designation from Open Space "O"- Scenic Combining "SC" to Single-Family Residential "R1"-Scenic Combining "SC" on property located at 9460 E. Highway 20, Glenhaven (APN 035-041-19) subject to the findings and based on the conditions listed in the staff report dated August 22, 2024. 3. The Planning Commission recommend that the Board of Supervisors approve the General Plan Amendment applied for by Melissa Lim to change the general plan designation from Public Facilities "PF" to Low Density Residential "LDR" on property located at 9460 E. Highway 20, Glenhaven (APN 035-041-19) subject to the findings and based on the conditions in the staff report dated August 22, 2024. 4. The Planning Commission adopt the Resolution recommending approval of the General Plan Amendment GPAP 23-02 and Rezone RZ 23-02 to the Board of Supervisors. The video of the August 22, 2024, Planning Commission hearing may be viewed online at: https://lakecounty.granicus.com/player/clip/739?view_id=1&redirect=true As described within the Planning Commission Staff Report, as a condition of approval for this project, the applicant will be required to get "as-built" permits from the Lake County Community Development Department, Building Division for the previously unpermitted conversion as well as all applicable permits for the rest of the work needed to complete the conversion to a residential structure. Sprinklers will also be required for a conversion to an R occupancy now that it will be used as a residence. If the rezone and general plan amendment are approved, the applicant would then upgrade the electrical panel and finish dry walling. No ground disturbance is being proposed with this project. SUMMARY OF ANALYSIS The project parcel size is only 4,225 sq. ft., with a width of 50 feet. According to the Lake County General Plan Land Use Density/ Intensity Standards in Chapter 3, Table 3-1 for the Public Facilities general plan designation, the Non-Residential Intensity - Floor Area Ratio (FAR) is 0.5-2.0. The FAR is 1,500 sq. ft. / 4,224 sq. ft.= 0.36 rounded. Therefore, the current general plan designation is nonconforming. Under the existing Lake County Municipal Code Zoning Ordinance Article 24, Section 21-24-10, subsection 24.11(b), the minimum lot size is 6,000 sq. ft. Therefore, the existing zoning designation is also nonconforming. Under the Lake County Municipal Code Zoning Ordinance Article 10, Section 21-10.10(b)2., when there is public water with a septic system, the minimum lot size must be 15,000 sq. ft. Therefore, under the proposed zoning designation, the parcel size would remain nonconforming with the Lake County Zoning Ordinance. According to the Lake County General Plan Land Use Density/ Intensity Standards in Chapter 3, Table 3-1 the minimum lot size is 6,000 sq. ft., so the proposed general plan designation would also remain nonconforming with the Lake County General Plan. Surrounding land uses include single-family residences to the west, east, and across State Highway 20 to the south. Approval of the rezone and general plan amendment would allow for a single-family residence which would be consistent with those uses. The proposed zoning district and General Plan designation would be consistent with surrounding designations. Please refer to the Planning Commission Staff Report for a full analysis of the proposed project. Per Lake County Municipal Code Article 47, the Planning Commission shall make a recommendation to the Board of Supervisors for approval of General Plan and Zoning Map amendments. After the close of the public hearing, the Planning Commission shall render its final decision of the proposed rezoning amendment. Within ten (10) days of said final decision, the Planning Commission shall transmit its decision in the form of a written recommendation to the Board of Supervisors. Such recommendation shall include the reasons for the recommendation, the relationship of the proposed rezoning amendment to the Lake County General Plan, and a copy of the proposed amendment The draft Ordinance to approve the Rezone is included in Attachment F, and the draft Resolution to approve the General Plan Amendment is included in Attachment G for the Board's consideration.

Staff recommends the Board of Supervisors take the following actions the following: A. Adopt the Ordinance, approving the Rezone (RZ 23-02) with the following findings: 1. That the rezone is consistent with the area's zoning designations. 2. That this rezone does not constitute 'spot zoning' based on adjacent zoning and existing land uses in the vicinity. 3. That rezoning this property from "O-SC" Open Space - Scenic Combining to "R1-SC" Low Density Residential - Scenic Combining will not be detrimental to the area or the County. 4. This project, with the exception of the existing and future non-conforming parcel size, would be consistent with the Lake County General Plan, Shoreline Communities Area Plan, and Lake County Zoning Ordinance. 5. That the violation of County Code Chapters 5 and 21 can be corrected by the approval of the rezoning with "as-built" building permits being obtained following the Board of Supervisors' decision. B. Adopt the Resolution, approving General Plan Amendment (GPAP 23-02) with the following findings: 1. That the General Plan Amendment is consistent with the area's General Plan designations with the exception of the existing and future non-conforming parcel size. 2. That a General Plan Amendment for this property from Public Facilities to Low Density Residential will not be detrimental to the area or the County. 3. (include fiscal and staffing impact narrative): Pursuant to Article XII (D) of the California Constitution, CSA #2 Spring Valley Water is proposing to increase current water rates. If adopted, the increases for the water service fees will be effective on or after November 15, 2024 and July 1 each year thereafter in the five-year planning period with no additional required action or notice by the District. A Rate Setting analysis developed by Lechowicz & Tseng Municipal Consultants in coordination with District Staff for Financial Planning, Revenue Requirements, and Rate Setting Analysis was accepted by the Board of Supervisors at a regularly scheduled meeting of the Board on June 18, 2024. The first reading of the ordinance was on September 24, 2024. This is the second reading.

Kelseyville Cemetery District: Two (2) vacancies Nellie Mae Gustafson

On August 15, 2023, your Board ratified the Agreement for Services, and on September 1, 2023, appointed Dr. Noemi Doohan to the role of Public Health Officer to ensuring that ongoing public health mandates for services would continue. And on June 4, 2024, your Board amended that Agreement to extend the contract term until August 31, 2025. Dr. Noemi Doohan has informed the department that she will be unavailable from October 10, 2024, through October 15, 2024, and recommends Dr. Panna Lossy as alternate coverage during her absence. After careful review, staff recommends appointing Panna Lossy, M.D., as the Alternate Public Health Officer for the County of Lake from October 1, 2024, through December 31, 2024, to provide Alternate Public Health Officer coverage.

Consideration of Alternate Public Health Officer Appointment and Professional Services Contract for a Term of Three Months for an Amount not to Exceed $25,000 for the Term of the Agreement, and Authorize the Health Services Director to Sign

On August 28, 2024, bids were received and publicly opened for the Lucerne Harbor Dredging Project. Two bids were received and the apparent lowest responsible bidder was Marz Engineering of Ukiah, CA. Please see the attached bid tabulation. In consideration of only two bids being received, as well as the significant discrepancy between Marz Engineering's bid and that of the next lowest bidder, staff communicated with Marz Engineering to ensure that their bid factored in the payment of prevailing wage and compliance with other labor laws as mandated by California Labor Code section 2810. Furthermore, Marz Engineering included with their bid submittal the mandatory Prevailing Wage and Related Labor Requirements Certification document, further establishing Marz Engineering's acknowledgment to pay prevailing wage and conform to other labor laws. The project is fully funded through Budget Unit 1781, Special Projects. A local workforce participation discount was included in the project specifications; however, the discount did not impact the calculation of the low bidder.

Approve the award of Bid No. 24-13 for the Lucerne Harbor Dredging Project in the amount of $211,700 to Marz Engineering; and authorize the Chair to sign the Agreement and the Notice of Award
