Designating The Thirty-First Day of August as International Overdose Awareness Day WHEREAS, International Overdose Awareness Day is a global campaign held on August 31 to end overdose, remember without stigma those who have died, and acknowledge the grief of family and friends left behind; WHEREAS, in 2022, 35 people fatally overdosed in Lake County which is the second-highest overdose death rate in the state of California and was 3 times higher than the California rate. Lake County's rate was 56/100k compared to California's rate of 19/100k deaths. Data from CA Overdose Dashboard WHEREAS, all overdose deaths are preventable via access to harm reduction, health care, substance use prevention and treatment services, and naloxone, the opioid overdose reversal agent; WHEREAS, people who use drugs continue to be stigmatized and marginalized, discouraging them from accessing care and treatment; WHEREAS, every person should have access to resources that prevent overdose and other causes of drug-related mortality, including naloxone, sterile needles, drug testing, and medication for addiction treatment; WHEREAS, in Lake County, dedicated prescribers of medication for addiction treatment, harm reduction providers, behavioral health providers, and addiction recovery programs work tirelessly to provide residents with these resources; WHEREAS, local communities play a crucial role in eliminating the stigma of addiction, including residents, elected officials, parents, private and public organizations, hospitals, law enforcement, first responders, schools, and colleges; WHEREAS, SafeRx Lake County, an overdose prevention coalition comprised of local agencies and organizations including Lake County Behavioral Health and Lake County Health Services, will host its fourth annual commemoration of International Overdose Awareness Day in Upper Lake Park on Saturday, August 17, from 10am to 2pm; NOW, THEREFORE, BE IT PROCLAIMED that the Lake County Board of Supervisors does hereby designate August 31 as International Overdose Awareness Day and urges Lake County citizens to join in this important observance.

Adopt Proclamation Designating the Thirty-First Day of August as International Overdose Awareness Day

Attached for your Board's consideration is Amendment One to the lease for the Courthouse Coffee Kiosk. The current agreement with MIX, LLC was approved by your Board on August 22, 2023 in the amount of $200 per month, with the term ending August 31, 2024. Due to the increase in electricity rates, the lease amount will be raised to $275 per month to cover the average cost of monthly utility use. This service, located in the Courthouse lobby, provides County employees and the public access to coffee, tea, meal replacement drinks as well as breakfast options. The kiosk is currently open Monday through Friday from 8AM - 2PM and is closed holidays.

Approve Amendment One for Coffee Kiosk Services by and between the County of Lake and MIX Lakeport, LLC in the amount of $275 per month from September 1, 2024 through August 31, 2025 and authorize the Chair to sign.

Approve School and Special Districts Resolutions Requesting the Lake County Board of Supervisors' Approval of Consolidation of each Districts' Election with the November 5, 2024, General Election

The Registrar of Voters is charged with the duty to appoint persons to serve in various positions in order to conduct the November 5, 2024, General Election as well as setting the rate of pay for each person working as a result of the General Election. Pursuant to section 12310 of the California Elections Code, I am submitting a resolution setting the rate of compensation for members of the precinct board and support staff for the upcoming November 5, 2024, General Election.

The Lake County Department of Social Services (LCDSS) contracts with Redwood Toxicology Laboratory, Inc. for the provision of drug and alcohol testing for Child Welfare Services (CWS) client families. Drug testing is, in many cases, required by law, and is necessary to ensure child safety and participant compliance with required programs. The current agreement (#240455) authorizes LCDSS to spend up to $30,000.00 per fiscal year from 2023 to 2026. Due to an unexpected increase in our testing volume, LCDSS must increase the contract's maximum allowance to ensure its capacity to continue drug testing. This amendment increases the maximum allowance to $35,000.00 for FY 23-24 while maintaining a $30,000.00 cap in subsequent years. LCDSS completed a Request for Proposal (RFP) for the original contract, which closed on May 15, 2023. Five bids were received, and Redwood Toxicology Laboratory, Inc. was chosen due to their better pricing, range of drug and alcohol testing services, and performance in prior contracts with LCDSS.

Approve First Amendment to Contract between County of Lake and Redwood Toxicology Laboratory, Inc. for Drug Testing, in the amount of $35,000.00 from July 1, 2023 to June 30, 2024, and $30,000.00 per fiscal year from July 1, 2024 to June 30, 2026, and authorize the Chair to sign.

(include fiscal and staffing impact narrative): The FY 24/25 LACOSAN-SE Capital Asset Budget includes an appropriation of $165,350 for the purchase of a Backhoe. The backhoe will be used to maintain the Southeast Treatment Plant. Equipment was sourced competitively through Sourcewell's cooperative purchasing contract with Sonsray Machinery (Sourcewell Solicitation Number #011723). The bid is in accordance with the County's purchasing code Section 2-38.4, Cooperative Purchases. Equipment quote, Sourcewell contract, and Administrative RFP/BID/ Contracts Cover Sheet Checklist are attached in the agenda packet. The Lake County Board of Supervisors will hold a hearing to consider the potential rescission of the tax sale completed on June 4th, 2024 for 9802 Venturi Dr (APN 052-092-020-000). Wen Ni purchased had the winning bid and owes a total of $100,245.55. Ms. Ni's deposit of $5,000.00 has been credited towards this amount for a total remaining balance of $95,245.55. Ms. Ni contends that she was unaware there was no longer a home on the property following a fire, and that the sale should be rescinded with her deposit refunded. The Treasurer - Tax Collector opposes this rescission and asserts that the tax sale was procedurally correct. In the event the Board of Supervisors grants a recission, a refund will be issued to the purchaser or a successor in interest for the purchase amount, plus interest pursuant to Revenue and Taxation Code �3731(b)(2)(A)).

The County of Lake applied for and received Community Development Block Grant (CDBG) funds to implement a microenterprise technical assistance program. The County received 105 inquiries, 54 people completed the State Microenterprise Self-Certification form, 17 people were out of the service area or not income eligible. The 37 eligible recipients received assistance with business planning, financial planning, business forecasting, credit and marketing assistance. There were four workshop series, these were Getting Financially Fit, Basic Business Readiness, Marketing Strategies, and Basic Business Credit Assistance. During the eighteen-month implementation period over two thousand hours were spent with individuals to determine eligibility, understand the goals and needs of the enrolled individuals, develop and revise workplans, assist in all aspects of business development including providing feedback on the initial business idea, business planning, market analysis and strategy development, developing projections, understanding credit, accessing capital and developing exit strategies. All individuals assisted were from the low/moderate income group with the vast majority as Sole Proprietors and self-employed. The program provided assistance to 13 existing business and 24 startup businesses throughout the unincorporated area of Lake County. The program assisted in capital infusion to participating businesses in the aggregate amount of over $100,000. Business assisted included construction/fabrication, agricultural producers, beauty and health service providers, business and residential service providers, artists, hospitality and food service, and automotive. Staff recommends approval to closeout CDBG Microenterprise Technical Assistance Grant 20-CDBG-12082.

Approve the Closing of the CDBG Economic Development - Microenterprise Grant.

The County of Lake was awarded a CDBG CV-1 grant in the amount of $202,859.00 under contract number 20-CDBG-CV1-00106. The funding was to support local for-profit businesses recovering from the effects of the COVID 19 pandemic. The county contracted with Community Development Services (CDS) to implement the loan program. Two loans were approved by the loan committee, Upper Lake Grocery received funds in the amount of $175,000, retaining 8 jobs, A/T Wanzer Grading & Excavating received funds in the amount of $210,000, of which $2,859 was the remaining CV-1 funds, the remainder of funds were issued through the CV2-3 grant, A/T Wanzer retained 6 jobs. In all, 14 jobs were retained by the allocated funding. The CDBG CV-1 Grant funds have been fully utilized, staff recommends closing out grant 20-CDBG CV-1-00106.

Approve the Closing of the CDBG Lake County Business Assistance Revolving Loan Fund Grant

California Health & Safety Code Section 40801 requires one Legal Professional, one Professional Engineer, one Medical Professional, and two Public Members be represented on the Lake County Air Quality Management District (LCAQMD) Hearing Board. Mark Burkdoll has served for the past 12 years as a Public Member on the LCAQMD Hearing Board. Mr. Burkdoll has a desire to make a contribution to the community and assist in protecting our air quality and has agreed to continue to serve on the LCAQMD Hearing Board and we are appreciative. Lowell Grant has served for the past 3 years as the Engineer Member on the LCAQMD Hearing Board. Mr. Grant has a good knowledge and understanding of the issues that come before the Hearing Board. Mr. Grant has shown a strong interest in the community and environmental matters and has agreed to continue to serve on the LCAQMD Hearing Board and we are appreciative. The Hearing Board has rarely met in recent years but prior years has met up to 8 times a year. The hearing process is both legalistic and technical in nature. Continuing Hearing Board members, as has been the case for the present Hearing Board, has helped greatly in making the process work smoothly and in the publics interest. Due to infrequent meetings, the advantages of having experienced Hearing Board members, and the fact that Mr. Burkdoll and Mr. Grant have indicated their willingness to continue, we ask that you re-appoint them. Staff believes the LCAQMD is fortunate to have Members with such strong credentials, history, and unique understanding of our community and environmental matters and are willing to continue to serve on the Hearing Board.

That the LCAQMD Board of Directors re-appoint Mark Burkdoll as one of the Public Members to the LCAQMD Hearing Board for a three year term. That the LCAQMD Board of Directors re-appoint Lowell Grant as the Professional Engineer Member to the LCAQMD Hearing Board for a three year term.

Lake County Behavioral Health Services entered the Organized Delivery System (ODS) of Drug Medi-Cal (DMC) under the 1115 Demonstration Waiver as authorized by the Federal Centers for Medicare and Medicaid on July 1, 2024. As a DMC-ODS County Plan, we can now offer expanded coverage to Medi-Cal beneficiaries for Substance Use Disorder Treatment Services. Notably, all Medi-Cal beneficiaries are entitled to residential SUD services if they meet criteria. The following rates have been established for Lake County for outpatient services. These are fee-for-service rates that are paid by provider type. We have agreed to pass-through 65% of this rate to our contracted service providers. These has been raised as a global issue across California counties and both the California Behavioral Health Director's Association and the California Department of Health Care Services are aware. There is advocacy to re-evaluate and raise the rates. However, because Lake's outpatient fee-for-service rates are robust, it is estimated that the patient revenue from outpatient services may be enough to cover the difference between reimbursement and cost of service for residential treatment. Sub-Acute Detoxification 3.2 $ 301.18 Lake Perinatal - Behavioral Health Short Term Residential $ 108.42 The approved DMC-ODS implementation plan identifies that several levels of service do not yet exist and we have committed to developing those services over a period of years. Notably, youth residential and Narcotic Treatment Program services must be developed. Additionally, inpatient withdrawal management must be provided in a hospital setting with a hospital. This will require collaboration with our local healthcare system.

Approve Resolution Authorizing the Behavioral Health Director to Sign the Standard Agreement and Contractor Certification Clause Between the County of Lake and the California Department of Health Care Services for Provision of Substance Use Disorder Treatment Organized Delivery System Services Under the 1115 Medicaid Demonstration Waiver.

The Community Corrections Partnership (CCP) on October 19, 2023, authorized the Probation Department to move forward with developing housing for justice-involved individuals to deal with the large amount of this population that are homeless in Lake County following incarceration. The CCP allocated $5,000,000 for this expense. This amount has not been added to the Probation Department budget because we were determining if this project was feasible with this amount of funding and a Request for Proposal process was conducted. The Probation Department is seeking to increase both revenues and appropriations by $5,000,000 for the FY 24/25 budget. The funds have already been received in fund 610 and are available to transfer once a contract is approved. The Probation Department has developed a plan for housing by contracting with Rural Communities Housing Development Corp. Attached is a Power Point presentation describing the proposal. Following the RFP process, a Notice of Intent was issued on May 14, 2024, selecting RCHDC for the housing project. No protests were received to that Notice. The Probation Department and the RFP committee believe this is the best project to meet the needs of justice-involved homeless. As such, the Probation Department requests that the attached Memorandum of Understanding and Funding Agreement Between County of Lake and Rural Communities Housing Development Corporation be approved by your Board and signed by the Chair.

This Amendment reflects rate changes for 2024-25. We have seen both number of placements and cost of placements increase over this past year.

Approve Amendment No. 2 to the Agreement Between County of Lake and Crestwood Behavioral Health for Adult Residential Support Services and Specialty Mental Health Services in the amount of $3,720,000.00 Fiscal Years 2022-23, 2023-24, and 2024-25 and Authorize the Board Chair to Sign.

Environmental Alternatives operates many facilities for youth, including Short Term Residential Treatment Programs (STRTP). California Assembly Bill 1051 now requires the Mental Health Plan (MHP) of Original Jurisdiction to maintain responsibility for the cost of Specialty Mental Health Services (SMHS) provided out of County, in most circumstances. As such, we expect a significant increase in contracts with out-of-County STRTP SMHS fee-for-service. We are working closely with the Probation Department, Child Welfare Department, and the Lake Count Office of education to ensure we are notified timely of STRTP placements. These three agencies are the placing agencies in our community. These costs are billed fee-for-service and are fully Medi-Cal reimbursable. We have conducted a Risk Assessment and Request for Qualifications with the providers to ensure they are in good standing. The purchasing process that supported this particular Agreement stemmed from a Request for Qualifications (RFQ) associated with a recent California State Senate Bill that required local behavioral health care services entities to contract with this particular category of facility. I look forward to presenting this item, and can provide further information on County Purchasing Ordinance compliance, if it pleases your Board.
