On November 22, 2022, an agreement was approved by the Board of Supervisors to provide videography services to the Lake County Municipal Advisory Councils (MACs) for the 22-23 fiscal year. Due to delays in the supply chain and the time required for training, the equipment was not ready to perform its duties as detailed in the agreement until June 2023. On July 11, 2023, the first amendment to the original agreement was approved by the Board of Supervisors extending the agreement through June 30, 2024. Originally, PEG provided videography services for 4 out of the 6 MACs. Later that year in November 2023, the Middletown Area Town Hall requested that PEG provide services to its meetings. Due to the increase of MACs being covered and longer meetings due to activities such as the Lake County 2050 General Plan Update, the $10,000 are close to being exhausted and will not cover the month of June's MAC meetings. The Amendment before the Board today offers to increase the agreement amount by $1,000 for a total amount not to exceed, $11,000 for the term of the agreement through June 30, 2024.

DESIGNATING JUNE 15, 2024, TO HONOR INDIAN CHILD WELFARE ACT DAY WHEREAS, the Indian Child Welfare Act (ICWA) was enacted by Congress in 1978 to address the crisis affecting American Indian and Alaska Native children, families, and tribes due to the high number of children being removed from their homes and placed in non-Indian foster or adoptive homes, often far away from their communities and culture; and WHEREAS, ICWA recognizes the inherent sovereignty of Indian tribes to determine the best interests of their children, aiming to keep Indian children connected with their families, communities, and cultural heritage; and WHEREAS, ICWA establishes minimum federal standards for the removal and placement of Indian children and affirms the importance of tribal authority in child welfare matters, ensuring that Indian children are placed in homes that reflect the unique values and traditions of their culture; and WHEREAS, the continued implementation and enforcement of ICWA are vital to the preservation of Indian tribes and the well-being of Indian children, providing them with a sense of identity and belonging that is essential for their development and success; and WHEREAS, the area known as Lake County has been developed upon the ancestral homelands of Indigenous peoples who have continuously inhabited, utilized, and stewarded the land since time immemorial and is also the home to 7 Federally recognized tribes: Big Valley of Pomo Indians Elem Indian Colony, Habematolel Pomo of Upper Lake, Koi Nation of Northern California, Middletown Rancheria of Pomo Indians of California, Robinson Rancheria of Pomo Indians, and the Scotts Valley Band of Pomo Indians; and WHEREAS, we recognize and honor the resilience and strength of Indian tribes, families, and children, and commit to supporting the principles and practices established by ICWA; and WHEREAS, on June 15, 2023 in the case of Haaland vs Brackeen, the United States Supreme Court decided to uphold and reaffirm the importance of the Indian Child Welfare Act (ICWA) by a vote of 7-2 where Justice Neil Gorusch stated "In adopting the Indian Child Welfare Act (ICWA) Congress exercised that lawful authority to secure the right of Indian Parents to raise their families as they please; the right of Indian children to grow in their culture; and the right of Indian Communities to resist fading into the twilight of History."; and WHEREAS, June 15, 2024, provides an opportunity to reaffirm our commitment to the Indian Child Welfare Act, to raise awareness about its importance, and to celebrate the progress made in protecting the rights and cultures of Indian children. NOW, THEREFORE BE IT PROCLAIMED, that the Board of Supervisors of the County of Lake, hereby designates June 15, 2024, as a day to honor the Indian Child Welfare Act and encourage all citizens to learn about and support the principles of the Indian Child Welfare Act, recognizing its significance in safeguarding the future of Indian children and their communities. Approve Continuation of Proclamation declaring a Clear Lake Hitch Emergency

The California Department of Forestry and Fire Protection found that its aerial and group surveys in Napa and Lake County revealed widespread conifer mortality leaving trees vulnerable to insect attacks and fire damage. On March 28, 2022, Governor Newsom issued Executive Order No. 7-77, that states the ongoing drought will have significant immediate impacts on communities. In response, the Lake County Risk Reduction Authority created the Lake County Tree Mortality Task Force established to investigate and address the extensive tree mortality in the County caused primarily by wildfire, drought and insect damage. The Lake County Tree Mortality Task Force members have attended several presentations from individuals with considerable expertise in both entomology and tree mortality, including Forest Advisor Dr. Michael Jones, an entomologist from University of California Cooperative. The overriding message was that failure to actively address tree mortality could result in the potential loss or degradation of forest habitats and associated ecological impacts, including the impact of wildlife, water and soil. And as such, create dangerous wildfire conditions that also threaten the safety of persons and property and will likely extend beyond the capacity of public safety services, personnel, equipment, and facilities of this County. This Resolution requests the following actions from Governor Newsom; 1) Proclaim a State of Emergency in Lake County and other afflicted areas of the State, 2) Seek designation of tree mortality areas within Lake County and other afflicted areas of the State under Section 8204 of the Agriculture Act of 2014 and seek additional Federal program support; and 3) Request a Presidential Declaration of Emergency or Major Disaster for this emergency.

Approve Continuation of Proclamation of the Existence of a Local Emergency Due to Pervasive Tree Mortality

The Board of Supervisors originally approved an emergency declaration for shelter crisis on January 24, 2023. The proclamation cited the lack of beds available for those experiencing homelessness and would assist in allowing shelters to continue as well as new shelters to be initiated. Due to the fact that the original proclamation discussed rain and snow as being part of the reason for declaring an emergency, a revised version of the emergency declaration is being brought back to the board to approve with revised recitals. We are still short of beds needed to provide shelter for all of those who are experiencing homelessness. However, great strides are being made at both Behavioral Health and the Continuum of Care with the support of the Board of Supervisors to make progress in what is available.

Approve Continuation of Emergency Proclamation Declaring a Shelter Crisis in the County of Lake

On March 12, 2024, the Board of Supervisors passed a Resolution for an application to the California Department of Housing and Community Development (HCD) to utilize Community Development Block Grant (CDBG) program income, not to exceed $372,232, to provide microenterprise technical assistance program funding and to extend the program to May 1, 2027. The State has reviewed the application, and the County anticipates approval. A condition of approval is the extension of the existing agreement between Community Development Services and the County to match the three-year grant period of the anticipated standard agreement between HCD and the County.

Approve Amendment to the existing Agreement between the County of Lake and Community Development Services for the CDBG Microenterprise Technical Assistance Program to utilize program income not to exceed $372,232 and extend the term of service to May 1, 2027, and authorize the Chair to sign.

I would like to ask the Board to adopt the attached resolution approving the agreement with the California Department of Food and Agriculture for inspection/ investigation/ enforcement work involving the Certified Farmer's Market Program. This program allows growers to sell their produce at a Certified Farmer's Market (CFM). This agreement reimburses the county for follow-up inspections, investigations, and enforcement actions taken. The agreement would reimburse the county up to $944.00 for billable activities listed in the scope of work. Should the Board adopt this Resolution, please have the chair sign, and return one copy of the Agreement, and one copy of the Board Resolution and return them to the Agricultural Commissioner's office for processing. A signed completed copy will be returned for your records.

This resolution respectfully request, pursuant to Election Code Section 10400 et seq, the Board of Supervisors of the County of Lake authorize consolidation of election services for the City of Lakeport for the State General Election on November 5, 2024.

Approve Resolution of the City Council of the City of Lakeport Calling for and Providing for and Giving Notice of the General Municipal Election to be held in the City of Lakeport, County of Lake, State of California, on the 5th Day of November 2024, for the Purpose of Electing Four (4) City Council Members, Three to hold Office for a Term of Four Years, and One to hold Office for a Term of Two Years, or until their Successors are Elected and Qualified, Requesting Consolidation of that Election with the State General Election and Requesting Approval of The Lake County Board of Supervisors for Election Services to be Provided by the Lake County Registrar of Voters

The Microenterprise Home Kitchen Operation (MEHKO) program is a special food program designed to encourage small business owners in the food operations industry. Special rules and allowances have been created for the MHKO owner, allowing them to prepare and sell food from their home. These activities have traditionally been limited to commercial operations, which can be expensive and difficult to start. AB 178 Funding will be used to provide direct support for the implementation of the MHKO program.

Approve Request to Accept MEHKO AB 178 Grant in the Amount of $36,122.64 and Authorize the Department Head to Sign the Acceptance Agreement

The California Department of Resources Recycling and Recovery provides funds to Local Enforcement Agencies to support solid waste facilities permit and inspections programs. Funds are based on the jurisdiction's population and the number of permitted, active solid waste facilities. We respectfully request your Board's authorization to submit the required grant applications to the California Department of Resources Recycling and Recovery.

Adopt Resolution Authorizing the Submission to the California Department of Resources Recycling and Recovery, Cal Recycle for Local Enforcement Agency Grant for the Period of July 1, 2024 through June 30, 2029

This Amendment increases the contract maximum and extends the term of the contract. This amendment and the associated cost have been factored into our budgetary needs to complete the 2023-24 fiscal year. These services are fully paid from the County's Opioid Settlement Funds. This will enable us to complete and submit for consideration an expenditure plan for the Opioid Settlement Funds.

Approve Amendment No. 2 to the Agreement between County of Lake and Health Management Associates, Inc. for Support Services for Consulting Services in the amount of $49,551.00 for Fiscal Year 2023-2024 and Authorize the Board Chair to Sign.

The current contract for janitorial services for Lake County Department of Child Support Services is scheduled to expire on June 30th, 2024. Child Support Services requested informal written quotes from three separate business on April 8th, 2024. Two businesses responded and Crackerjack Cleaning was selected based on their pricing.

Approve Agreement between the County of Lake and Crackerjack Cleaning for Janitorial Services from July 1, 2024 through June 30, 2025, not to exceed $35,000 and authorize the Board Chair to sign.

The plans and specifications for the Lucerne Harbor Dredging Project are complete, and a copy of the plans and specifications has been filed with the Clerk of the Board. The construction estimate is approximately $300,000. Appropriations are included in Budget Unit 1781, Special Projects.

Approve the Plans and Specifications and Authorize the Public Services Director to advertise for bids.

The Public Works Department respectfully requests Board approval to close Public Works and Water Resources Department facilities to the public on Thursday, June 13, 2024, between the hours of 12:00 PM and 5:00 PM With staff being spread out around the Lake between 5 satellite facilities (Roads and ISF) as well as DPW and Water Resources Administrative offices, joint gatherings are difficult to accomplish during public servicing hours. This event will include information sharing, team building exercises, and employee appreciation for the monumental work being done by staff. It will also be a time to introduce all the new employees hired over the last year and provide them with a better understanding of what the different divisions do. Thank you for your consideration in this matter.

Authorize the closure of all Public Works and Water Resources Facilities for Employee development, appreciation, and team building.

During May of each year, the County is required to submit to the Department of Transportation changes to the County-Maintained Road System. Due to staffing shortages, we just realized this was overlooked this year. Staff has prepared the Resolution for your consideration. You will note during the last year, there has been no change to the County-Maintained Road System as per Exhibit "A" attached.

This program is internationally acclaimed with a waiting list of over 1,000; and WHEREAS, his other contributions include learning how to write code in 1991 to create the university's first websites for livestock and natural resources and was an early adopter social media, which earned him a Silver Award in 2011 from the Association of Natural Resources Extension Professionals; and WHEREAS, his contributions to water quality research have been significant, including the development of the first rangeland water-quality ranch plan in California and the Rangeland Water Quality Planning Short Course; and WHEREAS, he has been recognized with multiple awards for his outstanding contributions to rangeland management, water quality, and agricultural education, including the Western Extension Directors Association Award of Excellence and the Society for Range Management's Outstanding Achievement Award-Stewardship; and WHEREAS, John Harper continues to contribute to the community through his emeritus status with UC Agriculture and Natural Resources and his ongoing mentorship of University of California Cooperative Extension County Director and Academic Advisors in Mendocino and Lake counties, as well as continuing the sheep shearing school. The County of Lake has been sponsoring 1Team 1Dream for the past 2 years. 1Team 1Dream offers an annual Lake County Business Competition. The $50,000 will support and help build a more resilient and sustainable small business economy in Lake County. The goal of the small business competition is to help build a resilient and thriving economy, a few small businesses at a time. The premise is that strong small businesses are the backbone of small rural economies, such as ours. The program prepares small businesses and entrepreneurs to become even more ready to fill commercial gaps throughout the County and to build a sustainable business. Included in the competition is business training, business plan revisions, and more to help develop our local business owners. The selected finalists present to a panel of judges. They introduce their business and how they intend to invest the funds from their prize earnings to develop/grow their business. 1Team 1Dream has grown to offer two separate categories of businesses: established businesses and startup businesses. Over the course of the past 4 years that 1Team 1Dream has been actively investing in our local businesses. 91 small businesses have gone through training, marketing, and a dynamic social media campaign. At the end of the competition, 1Team 1Dream has provided investment dollars to 27 local businesses: 6 in the City of Clearlake, 7 in the City of Lakeport, and 14 in the unincorporated area of Lake County. Last year's big winner and fan favorite was Tyrrel Martial Arts in Middletown whose plan was to expand his business into a new facility including the purchase of a van to pick up students to bring to his dojo. One of the first winners of the competition, Lam Printing in Clearlake doubled their business after the competition and is currently seeking a new facility to grow their business some more. The City of Lakeport grants $10,000, The City of Clearlake grants $30,000, and thus far the County of Lake has granted $30,000 to 1Team 1Dream as well. Currently, Budget Unit 1892, Marketing & Economic Development is budgeted with $30,000 to support 1Team 1 Dream's Lake County Business Competition. This year, we are requesting that the County increase that budgeted amount to $50,000.

Issue Conduct a public hearing under the Tax and Equity Fiscal Responsibility Act ("TEFRA") on June 11, 2024 in connection with the proposed issuance of revenue bonds by the California Municipal Finance Authority (the "CMFA"), a joint exercise of powers authority and public entity of the State of California, in an amount not to exceed $166,000,000, (the "Bonds"), to (a) pay costs of the 2024 New Money Project (as defined below) and (b) refund all or a portion of the Authority's outstanding Mobile Home Park Senior Revenue Bonds (Caritas Affordable Housing, Inc. Projects), Series 2014A (the "2014A Bonds"), and Mobile Home Park Subordinate Revenue Bonds (Caritas Affordable Housing, Inc. Projects), Series 2014B (the "2014B Bonds" and, together with the 2014A Bonds, the "2014 Bonds"), which 2014 Bonds were issued to finance and refinance the 2014 Project (as defined below, and as referred to herein collectively with the 2024 New Money Project, the "Project") Adopt a resolution to approve the financing of the Project by the CMFA. Recommendations 1) Conduct the public hearing under the requirements of TEFRA and the Internal Revenue Code of 1986, as amended (the "Code"). 2) Adopt the resolution approving the issuance of the Bonds by the CMFA for the benefit of Caritas Affordable Housing, Inc. (the "Corporation" and, together with the LLCs, the "Borrowers"), to provide for the financing of the Project, such adoption is solely for the purposes of satisfying the requirements of TEFRA, the Code and the California Government Code Section 6500 (and following). BACKGROUND: The Borrower requested that the CMFA serve as the municipal issuer of the Bonds in an aggregate principal amount not to exceed $166,000,000 of tax-exempt revenue bonds. The proceeds of the Bonds will be used for (a) pay costs of the 2024 New Money Project (as defined below) and (b) refund all or a portion of the Authority's outstanding Mobile Home Park Senior Revenue Bonds (Caritas Affordable Housing, Inc. Projects), Series 2014A (the "2014A Bonds"), and Mobile Home Park Subordinate Revenue Bonds (Caritas Affordable Housing, Inc. Projects), Series 2014B (the "2014B Bonds" and, together with the 2014A Bonds, the "2014 Bonds"), which 2014 Bonds were issued to finance and refinance the 2014 Project (as defined below, and as referred to herein collectively with the 2024 New Money Project, the "Project"). The term "2024 New Money Project" means all or a portion of the costs of: (a) the acquisition, construction, improvement and equipping of property located at 220 Camino Corto, Vista, California 92083 (the "Estrella Apartment Project") and at 2441 South El Camino Real, San Clemente, California 92672 (the "San Clemente Project"); (b) certain capital expenditures for the properties comprising the 2014 Project, including, but not limited to, the replacement of asphalt surfaces in and about such properties (the "Improvement Project"); and (c) certain working capital expenditures as permitted by the Code and the Treasury Regulations promulgated thereunder. The term "2014 Project" means financing and refinancing all or a portion of the costs of the acquisition, construction, improvement and equipping of: (a) a 285-space mobile home park known as Valley Village Mobile Home Park, located at 6401 Country Club Drive, Rohnert Park, California 94928 (the "2014 Valley Village Project" and, together with the portion of the Improvement Project at the 2014 Valley Village Project, the "Valley Village Project"); (b) a 67-space mobile home park known as Sterling Shores Estates Manufactured Housing Community, located at 5830 Robin Hill Drive, Lakeport, California 95453 (the "2014 Sterling Shores Project" and, together with the portion of the Improvement Project at the 2014 Sterling Shores Project, the "Sterling Shores Project"); (c) a 123-space mobile home park known as Desert Sands Estates Mobile Home Park, located at 4511 25th Street East, Lancaster, California 93535 (the "2014 Desert Sands Project" and, together with the portion of the Improvement Project at the 2014 Desert Sands Project, the "Desert Sands Project"); (d) a 164-space mobile home park known as Aztec Mobile Home Estates, located at 7425 Church Street, Yucca Valley, California 92284 (the "2014 Aztec Project" and, together with the portion of the Improvement Project at the 2014 Aztec Project, the "Aztec Project"); (e) a 100-space mobile home park known as Rancho Brea Mobile Home Estates, located at 1414 West Central Avenue, Brea, California 92821 (the "2014 Rancho Brea Project" and, together with the portion of the Improvement Project at the 2014 Rancho Brea Project, the "Rancho Brea Project"); (f) a 465-space mobile home park known as Friendly Village Mobile Home Park, located at 1301 East Avenue 1, Lancaster, California 93535 (the "2014 Friendly Village Project" and, together with the portion of the Improvement Project at the 2014 Friendly Village Project, the "Friendly Village Project"); (g) a 264-space mobile home park known as Hacienda Mobile Estates, located at 2330 East Avenue J 8, Lancaster, California 93535 (the "2014 Hacienda Project" and, together with the portion of the Improvement Project at the 2014 Hacienda Project, the "Hacienda Project"); (h) a 107-space mobile home park known as Estrella De Oro, located at 220 Camino Corto, Vista, California 92083 (the "2014 Estrella Project" and, collectively with the portion of the Improvement Project at the 2014 Estrella Project and the Estrella Apartment Project, the "Estrella Project"); and (i) a 159-space mobile home park known as Vista Manor Mobile Home Park, located at 200 Olive Avenue, Vista, California 92083 (the "2014 Vista Manor Project" and, together with the portion of the Improvement Project at the 2014 Vista Manor Project, the "Vista Project"). In order for all or a portion of the Bonds to qualify as tax-exempt bonds, the County of Lake must conduct a public hearing (the "TEFRA Hearing") providing for the members of the community an opportunity to speak in favor of or against the use of tax-exempt bonds for the financing of the Project. Prior to such TEFRA Hearing, reasonable notice must be provided to the members of the community. Following the close of the TEFRA Hearing, an "applicable elected representative" of the governmental unit hosting the Project must provide its approval of the issuance of the Bonds for the financing of the Project. CALIFORNIA MUNICIPAL FINANCE AUTHORITY: The CMFA was created on January 1, 2004 pursuant to a joint exercise of powers agreement to promote economic, cultural and community development, through the financing of economic development and charitable activities throughout California. To date, over 200 municipalities have become members of CMFA. The CMFA was formed to assist local governments, non-profit organizations and businesses with the issuance of taxable and tax-exempt bonds aimed at improving the standard of living in California. The CMFA's representatives and its Board of Directors have considerable experience in bond financings. FISCAL IMPACT: The Bonds to be issued by the CMFA for the Project will be the sole responsibility of the Borrower, and the County will have no financial, legal, moral obligation, liability or responsibility for the Project or the repayment of the Bonds for the financing of the Project. All financing documents with respect to the issuance of the Bonds will contain clear disclaimers that the Bonds are not obligations of the County or the State of California but are to be paid for solely from funds provided by the Borrower. The Board of Directors of the California Foundation for Stronger Communities, a California non-profit public benefit corporation (the "Foundation"), acts as the Board of Directors for the CMFA. Through its conduit issuance activities, the CMFA shares a portion of the issuance fees it receives with its member communities and donates a portion of these issuance fees to the Foundation for the support of local charities. With respect to the City of Gilroy, it is expected that that a portion of the issuance fee attributable to the City will be granted by the CMFA to the general fund of the City. Such grant may be used for any lawful purpose of the City. The Borrower will be the beneficiary of the CMFA's charitable donation through a 25% reduction in issuance fees. SUMMARY: In light of the foregoing, and in order to support affordable housing, staff recommends that the County conduct the TEFRA Hearing and adopt the resolution in favor of the issuance of the Bonds by the CMFA.

1) Conduct the public hearing under the requirements of TEFRA and the Internal Revenue Code of 1986, as amended (the "Code"). 2) Adopt the resolution approving the issuance of the Bonds by the CMFA for the benefit of Caritas Affordable Housing, Inc. (the "Corporation" and, together with the LLCs, the "Borrowers"), to provide for the financing of the Project, such adoption is solely for the purposes of satisfying the requirements of TEFRA, the Code and the California Government Code Section 6500 (and following).

In the past year, Lake County PEG has provided videography services for 39 Municipal Advisory Council (MAC) meetings. While PEG will not deny that technology, more specifically broadband, has been an issue with virtual hybrid capabilities, PEG has successfully been able to offer a robust recording and audio service to all MACs that have requested their services. PEG is continuing to invest in its equipment to overcome some of the obstacles and hiccups that we have experienced. However, it remains ready to continue to offer its services to provide transparency in Lake County MAC meetings with archived video of all meetings. PEG has recently purchased a StarLink mobile unit in hopes to better connect to the internet in areas where broadband deployment does not meet the needs of PEG's hybrid virtual meeting requirements. PEG is working on a better finished product with introductions prepared for each MAC and a list of the board members and contact information for contacting the MAC. We are working on our YouTube channel and our Website to better organize the MAC video archives to easily and quickly access the meeting that viewers are seeking. PEG is also starting conversations on upgrading individual Town Halls for easier setup and a better recording product. The agreement before the board offers to continue the PEG videography professional services for the next three fiscal years through June 30, 2027 with a maximum not to exceed $10,000 per fiscal year.

Approve Agreement for Professional Services between the County of Lake and Lake County PEG-TV for 2024-27 for a maximum not to exceed $10,000 per fiscal year

On January 11, 2024, the Board of Supervisors approved an Agreement with Black Dog DESIGNS for a County economic development website, marketing collateral, and website hosting services. That Agreement is part of RFP 24-04 Economic Development Design Services, which closed in September 2023. This Trails Website Agreement would also be part of RFP 24-04 as it aligns with the RFP's scope. The new trails website will feature materials from the dormant Konocti Trails System website, which won the Social Media, Websites and Technology Award from the California Trails Conference Foundation. As a result of its background building trails websites for local communities and the ability to leverage the brand development of the Lake County economic development website Black Dog DESIGNS was selected for the relaunch of the trails website. A relaunched trails website would have value for residents, visitors, and businesses in Lake County. The site would be utilized by the Tourism Improvement District (Visit Lake County) and the economic development marketing materials in development. Approximately 25% of visitors to the Konocti Regional Trails website were from Lake County, 43% from the Bay Area, and 85% from California. The site will feature trails, maps, descriptions of public lands, access points, and the County's Parks, Recreation, and Trails Master Plan.

This amendment and the associated cost have been factored into our budgetary needs to complete the 2023-24 fiscal year. These services must be paid for by the Mental Health Plan for all Lake County beneficiaries. These services are Medi-Cal reimbursable. Vista Pacifica is a Residential facility for SMHS services for adults.

Approve Amendment No. 2 to the Agreement between the County of Lake and Vista Pacifica Enterprises, INC. for Adult Residential Support Services and Specialty Mental Health Services in the amount of $400,000.00 for Fiscal Year 2023-2024

This Amendment increases the contract maximum to pay for services already rendered as well as cover to pay for services through the end of the fiscal year. This amendment and the associated cost have been factored into our budgetary needs to complete the 2023-24 fiscal year.
