Executive Summary
(a) This item is being submitted as an "extra" agenda item. The justification for this request to consider an item not on the posted agenda is as follows:
This item came to attention subsequent to the posting of the current agenda and there is a need to take action before the next agenda.
(b) Section 6-5 of the Lake County Code empowers the Director of Emergency Services to declare the existence or threatened existence of a Local Emergency when Lake County is affected or likely to be affected by a public calamity. The Sheriff/OES Director's Proclamation expires seven days after issuance unless confirmed and ratified by the Lake County Board of Supervisors.
As your Board is aware, as OES Director, I declared a Local Emergency in response to the Glenhaven Fire, which ignited October 4, 2024, near Hwy 20 and Glenhaven Drive in Glenhaven, CA. Over 400 acres burned, threatening over 2,000 structures and resulting in mass evacuations.
Staff recommends your Board recognize emergency conditions persist, and ratify the Local Emergency related to the Glenhaven Fire.

(a) Approve taking the item up as an extra since it came up after the posting of the agenda and needs to be addressed before the next available agenda.
(b) Approve Ratification of the Local Emergency Proclamation by the Lake County Sheriff/OES Director for the Glenhaven Fire

INDIGENOUS PEOPLES' DAY IN LAKE COUNTY
WHEREAS, the area now known as Lake County has been home to people for greater than 12,000 years, and the richly diverse cultures of the seven Tribal Nations indigenous to Lake County, Middletown Rancheria of Pomo Indians of California, Koi Nation of Northern California, Big Valley Band of Pomo Indians, Scotts Valley Band of Pomo Indians, Habematolel Pomo of Upper Lake, Robinson Rancheria of Pomo Indians of California and Elem Indian Colony, have informed every aspect of our community's history; and
WHEREAS, policies and practices of the United States and earlier colonial governments deprived Indigenous People in the State of California and Lake County, specifically, of landholdings, liberty, even life, itself; and
WHEREAS, the County of Lake is committed to protecting rights of Tribal organizations and institutions to strengthen their own communities; and
WHEREAS, Indigenous Peoples' Day was first proposed to the United Nations more than forty years ago; and
WHEREAS, in January 2019, Lake proudly became the first United States County with two concurrently seated American Indian Supervisors; and
WHEREAS, because of our historic position, we have a responsibility to lead in honoring and celebrating the legacy of all of America's Indigenous Peoples, and particularly those indigenous to Lake County.
NOW, THEREFORE, BE IT PROCLAIMED that the Lake County Board of Supervisors declares each 2nd Monday in October Indigenous Peoples' Day in Lake County.

HEAD START AWARENESS MONTH IN LAKE COUNTY
WHEREAS, established nationally in 1964, Head Start is a national, federally funded early childhood development program that serves children and families and whose purpose is to help children achieve their full potential; and
WHEREAS, Head Start provides comprehensive health, nutritional, educational, social services, family and community development and meaningful parent involvement; and
WHEREAS, Head Start focuses on children's language development, early literacy, social skills, and providing their parents the skills in becoming their child's first and best teacher; and
WHEREAS, Head Start is committed to the development of each child and provides preventative and early intervention services to children and families regardless of their economic status.
NOW, THEREFORE, BE IT PROCLAIMED the Lake County Board of Supervisors do hereby designate the month of October 2024 as Head Start Awareness Month.
BE IT FURTHER RESOLVED, the Lake County Board of Supervisors recognizes that the needs of children and families in Lake County must become a top priority for future decision makers by investing financial resources and talent in the support of health, mental health, educational disabilities, early childhood education, child abuse and neglect, and family trauma sensitive care.
BE IT FURTHER RESOLIVED, the Lake County Board of Supervisors encourages all parents of preschool age children to participate in literacy activities, such as reading a book with your child, attending a play with your child, and going to the library with your child during the month of October.

AS AGEISM AWARENESS DAY IN LAKE COUNTY
WHEREAS, Ageism refers to the stereotypes of prejudice and discrimination toward others based on age; and
WHEREAS, there are an estimated 21,058 older adults in Lake County over the age of sixty who are impacted by ageism; and
WHEREAS, ageism toward older adults affects their health and longevity, financial well-being and the economy of Lake County; and
WHEREAS, preventing ageism in education, employment, housing, and healthcare will benefit all; and
WHEREAS, recognizing that it is up to all of us to ensure that older adults are respected and portrayed as capable, competent, effective, and valued in all areas of society; and
WHEREAS, ageism awareness and preventing ageism is beneficial to all citizens of Lake County by improving quality of life within Lake County,

Executive Summary
DESIGNATING THE MONTH OF OCTOBER 2024 AS
DOMESTIC VIOLENCE AWARENESS MONTH IN LAKE COUNTY
WHEREAS, Domestic Violence impacts, women, children and men of all racial, cultural and economic backgrounds; and
WHEREAS, emotional and physical scars resulting from Domestic Violence are often severe and long lasting; and
WHEREAS, in the past 12 months, Lake County Law Enforcement responded to over 480 incidents of Domestic Violence, including men, women and children. In the past 12 months the Victim Witness Division of the District Attorney's office has served 407 victims of Domestic Violence, and the District Attorney's Office has prosecuted 243 felonies and misdemeanor acts of Domestic Violence. Lake Family Resource Center responded to 935 crisis line calls, served victims, and sheltered 127 domestic violence victims and their children for a total of 4,429 bed nights.
WHEREAS, it is crucially important to hold perpetrators responsible for assault and to prevent Domestic Violence at every opportunity; and
WHEREAS, family violence is a community problem, stopping the cycle requires not only the strength and courage of survivors, but also the support and involvement of all members of the community; and
WHEREAS, many organizations such as the District Attorney's Office, Sheriff's Office, Lakeport Police Department, Clearlake Police Department, and Lake Family Resource Center are committed to ending Domestic Violence in Lake County and provide essential crisis intervention and prevention services to all members of our community.
NOW, THEREFORE, BE IT PROCLAIMED that the month of October 2024 is designated as Domestic Violence Awareness Month in the County of Lake and our community is urged to support the efforts of the agencies assisting victims of domestic violence and to increase their involvement in efforts to prevent domestic violence, thereby strengthening our community and creating an environment which honors, nurtures, and protects all members of every family.

Executive Summary
Lake County is an amazing place to live, work, and play. Code Enforcement Officers play an important role in keeping it this way. Lake County Code Enforcement Officers are out in the communities, working with property owners and residents to preserve the residential character of our neighborhoods, as well as maintaining health and safety standards for commercial, and industrial areas.
Code Enforcement Officers oversee the daily operations of abandoned vehicle abatement, hazardous vegetation management, illegal dumping, nuisance abatement, and respond to a consistently robust collection of complaints from both the public and other departments. They conduct themselves with professionalism and respect the public's due process rights. They work collaboratively with other departments to address the more complex cases, as needed.
It is appropriate for the Board of Supervisors to set aside a week to commemorate the significant impact these dedicated public servants make in our County every day. Your consideration of this item is greatly appreciated.

Executive Summary
I would like to ask the Board to adopt the attached Resolution approving the agreement with the California Department of Food and Agriculture (CDFA) for exotic pest detection trapping to prevent the introduction and spread of injurious insects that would threaten the economic importance of the agriculture food supply grown in California This program is critical to Lake County's agricultural industry and local environment. Without a detection program in place, Lake County-grown commodities could not be shipped to other parts of the country or internationally due to quarantine requirements. This agreement term is July 1, 2024, through June 30, 2025, for $36,547.00.
Should the Board adopt this Resolution, please have the chair sign and return one (1) copy of the Agreement, and one (1) copy of the Board Resolution. A signed completed copy will be returned for your records.

The National Healthcare Coalition Preparedness Conference provides the opportunity for healthcare emergency management professionals around the country to share solutions to the ever-changing dynamics of the disasters we face in the world today. With over 40 sessions of content, sharing of best practices, building partnerships, and interacting with the latest technology and industry leaders, participants will benefit from advancing their individual and collective skill sets.

Executive Summary
The Office of Juvenile Justice and Delinquency Prevention Conference is being held in Washington, DC from November 19, 2024, through November 21, 2024. The conference will bring together youth justice partners, practitioners, youth and families, Office of Juvenile Justice and Delinquency Prevention grantees, and other stakeholders. This conference will feature over 80 workshops, 2 plenary sessions, and networking events. Conference sessions will provide the latest research, evidence-informed practices, and other promising approaches that have positively impacted the youth justice field, including children and their families where the child is in out-of-home care.
Because of the distance of the conference, I may need to travel the day before and the day after depending on the timing of the workshops.
Pursuant to the County of Lake Travel Policy 15-1.3(D), I respectfully request your Board's approval for me to travel out of State to attend the Office of Juvenile Justice and Delinquency Prevention Conference in Washington, DC.

Executive Summary
In October 2023 your Board approved an agreement with GSM Landscape Architects for professional design services for the Hammond Park Improvements Project. After completion of the 60% design submittal, GSM requested an amendment to perform extra services not included in their current agreement to respond to requests from County staff for value engineering, more plan revisions than originally anticipated, and completion of construction cost estimates for the changes. Additionally, geotechnical engineering services are proposed to be added to GSM's scope of work. Geotechnical engineering is anticipated to result in a net cost savings for the project by establishing suitable on-site engineered soil modification techniques that will significantly reduce or even eliminate the need to import more costly "select fill" material. Sufficient funds are available to pay for the amendment through the Statewide Park Improvement Program grant the County was awarded for the project.

WHEREAS, recognizing that it is up to all of us to ensure that older adults are respected and portrayed as capable, competent, effective, and valued in all areas of society; and

WHEREAS, Domestic Violence impacts, women, children and men of all racial, cultural and economic backgrounds; and
WHEREAS, emotional and physical scars resulting from Domestic Violence are often severe and long lasting; and
WHEREAS, in the past 12 months, Lake County Law Enforcement responded to over 480 incidents of Domestic Violence, including men, women and children. In the past 12 months the Victim Witness Division of the District Attorney's office has served 407 victims of Domestic Violence, and the District Attorney's Office has prosecuted 243 felonies and misdemeanor acts of Domestic Violence. Lake Family Resource Center responded to 935 crisis line calls, served victims, and sheltered 127 domestic violence victims and their children for a total of 4,429 bed nights.
WHEREAS, it is crucially important to hold perpetrators responsible for assault and to prevent Domestic Violence at every opportunity; and
WHEREAS, family violence is a community problem, stopping the cycle requires not only the strength and courage of survivors, but also the support and involvement of all members of the community; and
WHEREAS, many organizations such as the District Attorney's Office, Sheriff's Office, Lakeport Police Department, Clearlake Police Department, and Lake Family Resource Center are committed to ending Domestic Violence in Lake County and provide essential crisis intervention and prevention services to all members of our community.
NOW, THEREFORE, BE IT PROCLAIMED that the month of October 2024 is designated as Domestic Violence Awareness Month in the County of Lake and our community is urged to support the efforts of the agencies assisting victims of domestic violence and to increase their involvement in efforts to prevent domestic violence, thereby strengthening our community and creating an environment which honors, nurtures, and protects all members of every family.

Executive Summary
The community and economic development allocations of the California Department of Housing and Community Development - Community Development Block Grant Program (CDBG) requires a public meeting for the purpose of presenting eligible activities and projects for your Board's consideration during this year's grant application cycle. This presentation also provides an opportunity for the public to hear and comment on this year's eligible and potential activities and projects.
The community development and economic development allocations of the CDBG program published a combined Notice of Funding Availability (NOFA) each program year. Eligible cities and counties may submit up to three sub applications not to exceed $3,600,000. Economic development or housing programs or projects applications cannot exceed $1,500,000 each. Eligible activities under the above allocations in the NOFA may consist of planning and technical assistance, (studies and strategies), public assistance programs, employment training, and economic development programs or projects that create or retain jobs.
The county currently contracts with Community Development Services (CDS), a local firm based in Kelseyville, to prepare grant applications and implement CDBG funded activities on behalf of the County. Jeff Lucas with CDS will provide a brief presentation to the Board regarding the CDBG program and the application process for this year. Including applications for business loan programs and employment training programs.
Staff plans to present a Resolution for your Board's consideration on November 5th, 2024, related to this Notice of Funding Opportunity which will define the specific funding programs and amounts the County will pursue based on Board direction.

That date also commenced a 15-day public input period on the application and its narrative describing the proposed tasks and budget. In order to ensure adequate opportunity for the public to participate in this process, this noticed public hearing was scheduled prior to the closing of the public review period on October 9, 2024.
The PRO Housing grant is for five years, in an amount of up to $7,000,000, to improve affordable housing availability, rehabilitate substandard housing, update zoning and land use policies, and permitting procedures. Further details are available in the attached narrative and budget.

As your Board is aware, our Chief Building Official (CBO) is leaving the position with his last day being October 10, 2024, We are presently recruiting to fill the position. It is anticipated to take several months to fill the position and interim coverage is needed.
In compliance with Lake County Personnel Rule 1604.7, Staff requests the appointment of Plans Examiner II Jack Smalley as Interim CBO, effective October 11, 2024. Because the Plans Examiner class is non-exempt and CBO is exempt, as per Lake County Personnel Rule 1604.7F and 905, Board approval is needed for this interim appointment.
We would also like to request advanced step 2 due to Jack's two previous experiences as Interim Chief Building Official, five years as a Plans Examiner, ICC certifications, and past experience in construction and as a Building Inspector. Excerpts of the corresponding Personnel Rules are included below.
905 INTERIM APPOINTMENT
The Board of Supervisors may appoint a current permanent employee to an Interim Appointment in a non-elective exempt service classification. Such assignment is considered a temporary assignment effective on a date, at a rate, and for a period determined by the Board. Employees who accept an Interim Appointment receive all of the benefits and rights associated with the classification to which they are assigned for the period of that Interim Appointment. Upon the conclusion of such Interim Appointment the employee returns to his/her original classification and status.
1604.7 WORKING ABOVE CLASSIFICATION
F. Department Heads shall not authorize a non-exempt staff member to work above class in an exempt service classification. If the exempt service position allocation is vacant the Department Head may make a provisional appointment. In circumstances where the position is vacant but the exempt service allocation is not vacant, or when an immediate recruitment to fill a vacant exempt service allocation is not in the Department's best interests, the Department Head may request that the Board of Supervisors make an Interim Appointment to a non[1]elective exempt service classification.

We respectfully request BOS approval of a patch payment for BB, a conserved individual under our care as Public Guardian, for the County of Lake, at the recommendation of our Deputy Public Guardian, Lisa Walker-Coleman.
BB requires placement at Nazareth Classic Care to ensure appropriate care and support for his unique needs. Due to the level of care required a patch payment is necessary to cover the additional cost beyond the standard rate.
Public Guardian has conducted an assessment, and without this additional funding from the general fund, it will be nearly impossible to secure a stable and safe placement for BB. The patch payment will allow him to be placed in a facility that is well-suited for his medical and
psychosocial needs, promoting both his well-being and stability.
Attached, you will find detailed documentation supporting this request, including an analysis of
BB's current condition, the required level of care, and the cost breakdown for the placement. We have also attached two examples of similar historical patch payments for "TL" and "AB".
We appreciate your time and consideration in this matter. I am confident that this patch payment will significantly improve the quality of life for BB and help ensure his continued well-being under conservatorship.

Executive Summary
This item represents an initial description of a proposed Chapter 7 sale consisting of 3,323 parcels. Should your Board approve this preliminary proposal, the Treasurer - Tax Collector's office will continue preparation of this sale and return with a resolution to finalize the offering.
The tax collector is required to attempt to sell tax-defaulted property at either public auction or sealed bid sale within four years after the property becomes subject to sale, unless, by other provisions of law, the property is not subject to sale (Revenue and Taxation Code �3692(a)). If no bids are received at a tax sale, an attempt must be made to sell the property at intervals of no more than six years, until it is sold (Revenue and Taxation Code �3692(a)).
At this time, the Treasurer - Tax Collector's office has focused previous sales on all remaining properties in the City of Clearlake that have not been offered in the last 6 years, as well as all remaining properties throughout the County with an assessed value of over $5,000.00 not offered in the last 6 years.
Even with sales including more marketable and desirable properties, in a recent sale only 22% of properties offered received a bid. Properties worth less than $5,000 constituted:
- Approximately 22.4% of parcels;
- Only 0.8% of total tax bill (taxes and direct charges);
- Only 0.25% of base tax billed;
- A current delinquency rate of 34%;
- 74% of tax defaulted inventory eligible for sale.
If your Board rejects this proposed sale, the Treasurer - Tax Collector's office would then have the ability to attempt sales on the more recently defaulted properties. These sales have been, and would otherwise remain, on hold to address older inventory. In the meantime, the County can continue to pursue other options to address these low value parcels, including sales to agencies and a low value ordinance.
Recommended Action
Deny proposed Chapter 7 tax sale.
On motion of Supervisor Pyska, and by vote of the Board, approved in concept Proposed Chapter 7 Tax Defaulted Land Sale. The motion carried by the following vote:
